The petitioner seeks regular bail in connection with Ismailpur PS case no. 31 of 2014 registered for the offence punishable under Sections 302 and other sections of Indian Penal Code and 27 of Arms Act.
The FIR was lodged against ten named accused persons and five to six unknown persons. It is alleged in the FIR that all the accused persons made indiscriminate firing causing death of the informant's brother.
The learned counsel for the petitioner submits that the post mortem report of the deceased reveals that two gun shot injuries were found on his person. It is further submitted that similarly situated co-accused persons namely Rajesh
Patna High Court Cr.Misc. No.3995 of 2019(2) dt.25-01-2019 2/2 Mandal and Arvind Yadav have already been granted by coordinate Benches of this Court and co-accused namely Sarbin Yadav has been granted bail by this Hon'ble Court vide order dated 22.01.2018 passed in Cr. Misc. no. 2016 of 2016. Lastly, it is submitted that the petitioner is in custody since 03.10.2018. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of 2nd Addl. District & Sessions Judge, Naughachia, Bhagalpur in connection with Ismailpur PS case no. 31 of 2014.
