====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 11-02-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is seeking anticipatory bail in connection with Kaler P.S. Case No. 21/2018 registered under Sections 406, 420, 467, 471 and 120(B) of the Indian Penal Code, pending in the court of learned S.D.J.M., Arwal.

Learned senior counsel representing the petitioner has drawn the attention of this court towards the First Information Report and submits that so far as this petitioner is concerned, she has been involved in this case by merely describing her as one of the agents of the non-banking finance company. The informant has herself stated that she had deposited her money through main agent Anjum Praveen. One Manoranjan Kumar happened to be the Manager of the company. So far as this petitioner is concerned, there is no specific allegation that she had collected money from

Learned senior counsel submits that admittedly the money was being deposited by the informant through her agent in the non-banking finance company and so she had taken the risk of investment. Learned A.P.P. representing the State has opposed the prayer for anticipatory bail of the petitioner.

Considering the facts and circumstances of the case whereunder it is the submission of learned senior counsel that there is no specific allegation against the petitioner and she is neither the Manager nor the Director of the company in which the money was being deposited by the informant as also that she has got clean antecedent, in the event of her arrest/surrender before the court below within a period of four weeks, let the above-named petitioner be enlarged on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Arwal, in connection with Kaler P.S. Case No. 21 of 2018, this will be in addition to condition prescribed under Section 438(2) of the Code of Criminal Procedure.
