Petitioners are not named in the first information report and admittedly, there is previous enmity between petitioners and the informant. Moreover, there is no eye-witness of alleged occurrence and some witnesses claimed to have seen petitioners running behind the house of the informant. Furthermore, it appears that wife of the informant claimed in her statement recorded under section 164 Cr.P.C that she had seen petitioners coming out from her house after alleged occurrence.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the above named petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties
