The petitioners are accused in connection with Bhagwan Bazar P.S. Case No.429 of 2019 registered under Sections 363,365,302 and 34 of the Indian Penal Code. The accusation is that father of the informant had gone at the the house of Rajendra Mahto (petitioner no.1) for contract work at Digha, Patna. Without giving any information contractor Rajendra Mahto (petitioner no.1) sent the dead body of his father in the night through his helper Raj Kishore Rai (petitioner no.2). Informant saw the several firearm injury on the body of his father.

No.460 of 2020(2) dt.20-01-2020 2/2 Learned counsel for the petitioners submit that in fact father of the informant died in road accident and thereafter on the instruction of Rajendra Mahto (petitioner no.1), Raj Kishore Rai (petitioner no.2) accompanied the dead body at the house of the informant. Further submits that while it is alleged that several firearm injuries were seen over the dead body but in the postmortem cause of death is shown due to injuries caused by hard heavy substance. Both the petitioners are in custody since 07.09.2019 and police has already submits charge sheet.

Having regard to the facts and circumstances of the case, the, the petitioners above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge,IIIrd, Saran at Chapra in connection with Bhagwan Bazar P.S. Case No.429 of 2019.
