2. The petitioner seeks bail in connection with Special Case (POCSO) No. 228 of 2023 arising out of Bikram P.S. Case No. 387 of 2023 registered for the offence punishable under Sections 342 and 376 of the Indian Penal Code and Section 4 of the POCSO Act.

3. As per the prosecution case, the petitioner is accused of committing rape upon a victim girl aged about 17 years.

4. It has been submitted by learned counsel for the petitioner that the victim was known to the petitioner from before and she has herself accompanied the victim. This is not the case which is apparent from the FIR as well as the statement

5. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

6. In view of the fact that the petitioner is accused of kidnapping and rape, I am not inclined to grant bail to the petitioner.
