Mr.A.G ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 02-03-2022 Heard learned counsel for the petitioner and the State. Earlier prayer for bail of the petitioner was refused by this Court vide order dated 20.3.2020.

Learned counsel for the petitioner submits that during trial 6 witnesses have been examined. Out of 6, one is Hawaldar namely Shankar Paswan and two are Chaukidars namely Md. Raju and Ramjanam Prasad who were posted and on duty at Dumra Police station. None of the three witnesses have identified this petitioner in course of examination in court. Petitioner is in custody since 30.8.2019.

Considering the period of incarceration of the petitioner and the deposition of witnesses, prayer for bail of the petitioner is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the
