JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-02-2015 Heard learned counsels for the petitioners and the State. The petitioners are languishing in custody since 3.11.2014 in a case registered for the offences punishable under Sections 395 and 397 of the Indian Penal Code. The accusation is of committing dacoity in the house of the informant.

It is submitted by the learned counsel for the petitioners that the petitioners are not named in the FIR. Their names subsequently sprang up in the confession of co accused. It is further submitted that there is no recovery from the petitioners nor the petitioners have been put on test identification parade. Statement has been made in paragraph 3 of the petition that the

Patna High Court Cr.Misc. No.6501 of 2015 (2) dt.19-02-2015 2/2 petitioners have no criminal antecedent. More over, co accused Tanweer Alam alias Md. Tanweer Alam has been granted bail vide Cr. Misc. No. 4873 of 2015.

Considering the aforesaid facts, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Katihar in connection with Kadwa (Balia Belon) P.S. Case No. 183 of 2014.
