This is a petition for grant of regular bail for offence under Sections 419, 420, 467, 468, 469, 471 and 120B of the Indian Penal Code.
According to first information report, there is allegation of withdrawal of money from the referred Bank account by producing a forged and cloned cheque.
Submission of the learned counsel for the petitioner is that the petitioner is neither named in the first information report nor there is specific material to substantiate that the petitioner had withdrawn any of the referred amount. Only material against the petitioner is confession before the police and on similar circumstance co-accused, Chandan Kumar, has already been allowed bail by a coordinate Bench of this Court in Cr. Misc. No. 6659 of 2014.
The learned counsel for the Economic Offence Unit has opposed the prayer for bail, however, does not dispute the
Patna High Court Cr.Misc. No.9545 of 2017 (3) dt.21-06-2017 2/2 factual position of this case, aforesaid.
Considering the entire facts and circumstances, above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each in connection with Economic Offence P.S. Case No. 22 of 2012 to the satisfaction of the Subdivisional Judicial Magistrate, Patna, or successor Court. (Birendra Kumar, J) SA/- U √ T √
