The petitioners are apprehending their arrest in connection with Barhiya P.S.Case No.50 of 2018 , registered for offences punishable under Sections 302/34 of the Indian Penal Code.

Allegation against the petitioners is that they have assaulted by fists and slaps and also by the 'BUT' portion of the Gun.

Submission of the learned counsel for the petitioners is that through the specific allegation has not been attributed against any of the petitioners and further the other similarly

Patna High Court CR. MISC. No.2527 of 2019(3) dt.25-03-2019 2/3 situated co-accused persons, have been granted privilege of anticipatory bail, vide order dated 3.12.2018 passed in Cr.Misc. No.55187 of 2018 and order dated 29.8.2018 passed in Cr.Misc. No.38809 of 2018.

Heard learned A.P.P. , who has opposed the pryaer for bail on the ground that postmortem report shows that the death is due to excessive bleeding.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Lakhisarai in connection with Barhiya P.S.Case No.50 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure. With the aforesaid observation, this application is allowed.
