JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-03-2015 Petitioner is languishing in custody since 28.11.2014 in a case registered for the offences punishable under Sections 302, 307, 324, 34 of the I.P.C. It is alleged that petitioner and other accused persons came to the informant, inquired about the son of the informant namely Ramdev Paswan. Co-accused Nagina Devi demanded rupees five thousand from Ramdev Paswan which was denied by Ramdev Paswan resulted into hot exchange. In the meantime, co-accused Chandeshwar Paswan pierced knife in the chest of Ramdev Paswan. When the informant tried to catch him then other co-accused including the petitioner assaulted the informant. When the other son of the informant came to rescue then he was also caused knife injury. Ramdev Paswan subsequently succumbed to the injuries.
Patna High Court Cr.Misc. No.10699 of 2015 (2) dt.23-03-2015 2/2 It is submitted by learned counsel for the petitioner that petitioner is agnate of the informant and the other co-accused Satan Paswan and Antu Devi have been granted bail vide Cr. Misc. No. 23261 of 2011 and Cr. Misc. No. 22832 of 2014.
Considering the fact that accusation of assaulting the victim Ramdev Paswan is against the husband of the petitioner who is in custody, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Adhoc Additional Sessions Judge-I, Sitamarhi in connection with Majorganj P.S. Case No. 54 of 2008.
Since the case was instituted in 2008 and petitioner surrendered in 2014, let learned Court below cancel the bail bonds of the petitioner if she defaults for three consecutive occasions during trial.
