The petitioner seeks bail in a case registered for the offence under Section 399, 402 of the Indian Penal Code. Petitioner has been made accused in this case on the basis of confessional statement of co-accused Subodh Mandal, who was apprehended with one knife and two iron rod. It is submitted on behalf of petitioner that as per F.I.R. itself, petitioner was not arrested on spot and no arms or ammunition has been recovered either from his possession or from his house. It is further submitted that though, petitioner is accused in four more cases, but in all the cases, he is on bail. Petitioner is in custody in this case since 03.04.2021. Learned A.P.P. for the State has opposed the bail petition.

Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Sitamarhi P.S. Case No. 251 of 2021.
