Learned counsel for the petitioner submits that this writ application may be disposed of with liberty to the petitioner to prefer statutory appeal provided under the Bihar Targeted P.D.S. (Control ) Order, 2016 (hereinafter referred to as 'the Control Order, 2016') before the District Magistratecum-Collector, Madhubani (respondent no. 2). Learned counsel for the State has no objection to the petitioner availaing for an appropriate remedy in accordance with law.

Patna High Court CWJC No.558 of 2019(2) dt.03-05-2019 2/2 In the given facts and circumstances, this writ application is disposed of with liberty to the petitioner to prefer statutory appeal within a period of 30 days from today wherein he may take all such pleas which are available to him and on the petitioner's preferring statutory appeal before the respondent no. 2 within the prescribed period, the same shall be considered in accordance with law and will be disposed of within the statutory period prescribed under the Control Order, 2016. In case any question of limitation arises for consideration, the authority concerned shall consider the same keeping in mind that the petitioner was pursuing his remedy before this Court.
