The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 399, 402, 413, 414 of the Indian Penal Code and Sections 25(1-b)a, 26, 35 of Arms Act.

As per the prosecution case, F.I.R. has been lodged against six named accused persons including the present petitioner. It has been alleged that in the said case, two country made loaded pistol and two live cartridges have been recovered from the possession of

Patna High Court CR. MISC. No.7864 of 2024(2) dt.20-02-2024 2/3 co-accused Md. Shamim @ Samiya and Santosh Kumar Bhagat@ Sintu Bhagat. It is further alleged that two stolen motorcycles have also been recovered, out of which one is alleged to be recovered from the possession of the petitioner.

It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case. There is no independent witness of the alleged seizure. It is further submitted that petitioner is resident of Patna and on the alleged date of occurrence, he has visited to the house of his relative to attend a family function. In the way, police personnel dragged the petitioner in the present case with false and concocted allegations. Moreover, he is languishing in judicial custody since 11.07.2023. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Similarly situated co-accused, namely, Santosh Kumar Bhagat @ Sintu Bhagat @ Santosh Bhagat has been granted bail vide

Patna High Court CR. MISC. No.7864 of 2024(2) dt.20-02-2024 3/3 order dated 17.02.2024, passed in Cr. Misc. No. 7362 of 2024 by the co-ordinate Bench of this Court. Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Katihar (Sahayak) P.S. Case No. 516 of 2023 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar.
