JUSTICE RAKESH KUMAR ORAL ORDER 16-08-2016 Heard Sri Sunil Kumar No III , learned counsel for the petitioner, learned A.P.P. as well as Sri Pramod Kumar Pandey, learned counsel who has voluntarily appeared on behalf of complainant /informant.

The petitioner , who is in custody since 11.4.2016 in Turkaulia P.S. Case No. 56 of 2016 registered on the basis of a complaint case i.e. Complaint Case No. 2658 of 2015 for the offence under section 341, 323, 427, 447, 504 of the Indian Penal Code and section 3(1) (x) of the Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that falsely petitioner has been made accused. Earlier complaint

Patna High Court Cr.Misc. No.31922 of 2016 (2) dt.16-08-2016 2/2 was filed which was subsequently referred to the police whereas Sri Pandey, learned counsel for the informant has vehemently opposed the prayer for bail.

Keeping in view the nature of accusation and period of custody , let the petitioner Binda Sah be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in connection with Turkaulia P.S. Case No. 56 of 2016.
