Perusal of previous order-sheet shows a report was called for from the learned Additional District and Sessions Judge, Saran at Chapra regarding order dated 26.02.2022 passed in B.P. No. 140 of 2022 whereby learned court granted bail to the petitioner with an explanation as to under what circumstances the bail has been granted by the court when the matter was pending before this Court.

A report has been received from the court of learned Additional district and Sessions Judge- 8th, Saran at Chapra wherein he has submitted that the bail petition of the petitioners

Patna High Court CR. MISC. No.2606 of 2022(5) dt.21-12-2022 2/2 of the B.P. No. 140 of 2022 was filed with submission that Cr. Misc. petition filed before the High Court was withdrawn. It appears that the petitioner played fraud upon the learned trial court and concealed the fact about pendency of Cr. Misc. Petition No. 2606 of 2022 which has been pending before this Court.

Under the circumstances, the matter is disposed of with direction to the learned trial court to take appropriate steps for false averments being made before it while moving bail petition on behalf of the petitioners.
