The petitioner is in custody since 18.12.2014 in connection with Kanti P.S.Case No.638 of 2014 registered under Section 395 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner was not named in the F.I.R. The name of the petitioner figured in the case on the basis of confessional statement of a co-accused but the petitioner was not put on T.I.P.

Considering the aforesaid submissions and also the fact that the petitioner is in custody since 18.12.2014, let the petitioner Mahendra Mahto be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, (West), Muzaffarpur in connection with Kanti P.S.Case No.638 of 2014.
