The petitioner apprehends his arrest in connection with Obra PS Case No. 12 / 2022 dated 08-01-2022 registered under Section 147, 148, 149, 341, 323, 504, 506, 379, 307 of the IPC and Section 27 of the Arms Act.
As per the FIR the petitioner assaulted the informant by means of Garasa on his head due to which informant received grievous injury.
Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case due to family dispute.
On the other hand, learned counsel for the State submits that petitioner has criminal antecedent and from perusal of the impugned order it would be evident that the informant has
Patna High Court CR. MISC. No.2842 of 2023(3) dt.18-05-2023 2/2 sustained grievous injury on the right side of the temporal region which has been opined by the doctor as grievous in nature.
Regard being had to the submission made by the petitioner, taking into consideration the material on record and the fact that petitioner has assaulted by means of Garasa on the head of the informant causing grievous injury, I am not inclined to grant anticipatory bail to the petitioner. The petition stands rejected.
