JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-03-2015 Petitioner is languishing in custody since 01.12.2014 in a case registered for the offences punishable under Section 379 of the I.P.C and Section 135 of the Electricity Act.
One 25 KVA transformer worth Rs. 59,000/- was stolen from the village Baswariya which was in consequence to the theft of 16 KVA transformer from the village Parsauni. The First Information Report was registered against unknown. The name of the petitioner subsequently sprang up during investigation when he confessed his guilt. It is submitted by learned counsel for the petitioner that in pursuance to the confession there is no recovery from the petitioner. Moreover petitioner is a disabled person. A supplementary affidavit to that effect has been filed. A statement has been made in para 3 of the
Patna High Court Cr.Misc. No.10258 of 2015 (2) dt.20-03-2015 2/2 petition that petitioner is accused in one other case apart from the present one.
Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Bagaha, West Champaran in connection with Chautarwa P.S. Case No. 273 of 2013.
