The petitioner is apprehending his arrest in connection with Piar (Hatha O.P) P.S. Case No. 228 of 2019 for the offence registered under Sections 272, 273 and 120 (B) of the Indian Penal Code and Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recoveries were from other persons and not from the present petitioner.

Considering the fact that the recoveries were not made from the conscious possession of the petitioner and that the petitioner has no criminal antecedent, let the petitioner, above named, in the event of his arrest/surrender before the learned
