The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 147, 149, 341, 307, 504, of the IPC.
The allegation against FIR named accused persons is that when, informant and his cousin brother had gone to attend nature call in the meantime petitioner along with coaccused persons assaulted the cousin brother of the informant by means of pasuli and sword due to which his brother sustained injury.
Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.5721 of 2023(2) dt.01-05-2023 2/2 petitioner is innocent and has committed no offence. Both parties are agnates and due to which he has falsely been implicated in this case. There is case and counter case between the parties and both parties sustained injury. It is further submitted that the petitioner has got no criminal antecedent moreover, he languishing in judicial custody since 19.10.2022.
Learned APP appearing for the state has opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as judicial custody, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Parasbigha P.S. Case No. 97 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Jehanabad.
