06-07-2021 Heard learned counsel for the parties through video conferencing.

The petitioner seeks bail in Harnaut P.S. Case No. 175 of 2020, registered for the offence under Section 307 & other allied sections of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution case, this petitioner is alleged to have caused fire-arm injury on the chest of Ram Niwas Paswan (uncle of the informant).

It is submitted on behalf of petitioner that due to petty dispute amongst children, the alleged occurrence has taken place. The doctor has found one lacerated wound on chest in left side, size- 1⁄2 inch. Petitioner has been remanded in this case on 22.06.2020.

Patna High Court CR. MISC. No.13949 of 2021(3) dt.06-07-2021 2/2 Learned counsel for the State and informant have opposed the bail petition. Counsel for the informant submits that there is specific allegation against petitioner of giving fire-arm injury on the chest of the deceased.

Considering the aforesaid facts & circumstances and the fact that there is specific allegation against this petitioner, I am not inclined to grant bail to the petitioner. However, once charge has been framed and trial is commenced, the petitioner shall be released on bail by the learned trial court on its own satisfaction and on the condition that petitioner will cooperate in disposal of trial and appear before the court, as and when required.

With above observation, the petition stands disposed of.
