JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 25-06-2019 This application under Articles 226 and 227 of the Constitution of India has been filed by the petitioners for quashing the first information report of Gandhi Maidan P.S. Case No. 59 of 2015 instituted under Sections 406, 420 and 120-B of the Indian Penal Code.
A counter affidavit has been filed on behalf of the State wherein it has been stated that on completion of investigation final form holding the case to be of civil nature has already been submitted vide Final Form No. 27 of 2016 dated
Patna High Court CR. WJC No.81 of 2019(4) dt.25-06-2019 2/2 17.02.2016.
In view of the fact that investigation is over and the police have found the case to be of civil nature and the petitioner has not been sent up for trial, the application has become infructuous.
