The petitioner is in custody since 22.11.2014 in connection with Forbesganj (Simraha) P.S. Case No.729 of 2014 registered for the offences under Sections 395, 412 and 120B of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner has nothing to do with the occurrence of Bank dacoity. The petitioner's name was brought into the present case on the basis of the confessional statement of himself made before the police, which has no evidentiary value. It is further submitted that the petitioner has not been put on T.I. Parade till date and has been languishing in jail. There is also no recovery either from the
Patna High Court Cr.Misc. No.11984 of 2015 (3) dt.26-05-2015 2/2 possession of the petitioner or from his house. Considering the aforementioned submissions and also the fact that other similarly situated co-accused Chandan Kumar Rajbhar has been extended the privilege of regular bail by a Bench of this Court in Cr.Misc. No.10515 of 2015, vide order dated 23.3.2015, let the above named petitioner be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria, in connection with Forbesganj (Simraha) P.S.
