2. The petitioner apprehends his arrest in Baruraj P.S. Case No. 51/2024, registered for the offences punishable under Sections 414, 34 of the Indian Penal Code and sections 25(1-B) (a), 26 and 35 of the Arms Act.

3. The prosecution case, in brief, is that upon seeing the police party, the petitioner and another co-accused person tried to flee away from the place of occurrence but the coaccused person namely Aman Kumar was apprehended by the police who disclosed the name of the petitioner. It is further alleged that one motorcycle registered in the name of the petitioner was also seized from the place of occurrence.

4. Learned counsel for the petitioner submits that the

Petitioner has been made accused on the basis of confessional statement of apprehended co-accused person. No incriminating materials has been recovered from the possession of this petitioner. Petitioner claims clean antecedent.

5. Learned APP for the State has vehemently opposed the prayer for bail of the petitioner.

6. Considering the aforesaid facts of the case, this application for anticipatory bail is allowed.

7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, First Class, Court No. 5, Muzaffarpur, in connection with Baruraj P.S. Case No. 51/2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Ranjeet/- U T
