JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-02-2020 The petitioner seeks regular bail in connection with Khizersarai P.S. Case No. 301/2019 arising out of POCSO Case No. 113/2019 registered for offences punishable under Section 366A of the Indian Penal Code and section 10 of the POCSO Act.
Allegation against the petitioner is of kidnapping the minor daughter of the informant.
It has been submitted on behalf of the petitioner that the girl and the petitioner has been recovered from the village itself and the age of the girl was assessed as 19 years. Further, he has been in judicial custody since 14.10.2019. It has also been submitted that materials collected in course of investigation discloses that victim had herself fled away and residing in the village itself.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (POCSO Act), Gaya, in connection with Khizersarai P.S. Case No. 301/2019 arising out of POCSO Case No. 113/2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
