Petitioner apprehends his arrest in a case registered for the offence punishable under sections 272 and 273 of I.P.C. and section 30(a) of the Bihar Prohibition and Excise Act. The prosecution case, in brief, is that the recovery of 35 litres of illicit liquor has been made from house of the petitioner.

Learned counsel for the petitioner, while refuting the allegation, submits that petitioner has falsely been implicated in this case. It has further been submitted that nothing has been recovered from the conscious possession of the petitioner. Petitioner has got no criminal antecedent. In view of the nature of allegation against the petitioner and the fact that illicit liquor has been recovered from house of the petitioner, the prayer for bail is refused.
