The petitioner Petitioner seeks regular bail in connection with Bidupur Police Station Case No. 286 of 2018 registered for the offences punishable under Sections 394/302/ 396 of the Indian Penal Code.

This is the second attempt on behalf of the petitioner for grant of regular bail. Earlier, the prayer for regular bail of the petitioner was rejected by this Court, vide order, dated 11.04.2022, passed in Criminal Misc. No. 33752 of 2021. The allegation against the petitioner, as per the First Information Report, is the informant was intercepted by unknown criminals who tried to snatch the bag from the informant and upon protest, the accused persons fired upon the

Patna High Court CR. MISC. No.6373 of 2023(3) dt.22-02-2023 2/2 informant, due to which, he sustained injuries and in course of treatment, he died.

Learned Counsel for the petitioner submits that the petitioner is in custody since 12.11.2020 and the trial has not registered any substantial progress inasmuch as no prosecution witness has been examined during the trial as yet. This Court, vide order, dated 01.02.2023, had called for a report from the learned Court below regarding the stage of the case and in pursuance of the said order, a report has been submitted by learned 11th Additional Sessions Judge, Vaishali, at Hajipur, and from perusal of the same, it would be evident that charges have not been framed against the accused persons. After having heard learned Counsel for the parties and taking into consideration the criminal antecedent of the petitioner inasmuch as he is accused in fifteen criminal cases, and the nature of allegation levelled in the First Information Report, I am not inclined to grant regular bail to the petitioner. This application is, accordingly, dismissed.
