2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 126(2), 115, 118(1), 76, 324(1), 303(2) and 3(5) of the B.N.S. and Section 66(E) of the I.T. Act.
3. As per prosecution case, all the accused persons named in the F.I.R., including this petitioner, assaulted informant and his family members.
4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is innocent and has committed no offence. As a matter of fact, on a petty dispute a scuffle took place between the parties and only with a view to harass and humiliate the petitioner and others, this false and concocted case has been lodged. There are general and omnibus
Patna High Court CR. MISC. No.4146 of 2025(2) dt.24-02-2025 2/2 allegations and there is no specific accusation of overt act against this petitioner. It is further submitted that there is case and counter-case between the parties. Petitioner claims clean antecedents.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.
6. Considering the aforesaid facts and circumstances, general and omnibus nature of accusation, case and counter-case between the parties and clean antecedents of the petitioner, the prayer for grant of anticipatory bail to the petitioner is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-III, Jhanjharpur in connection with Madhepur P.S. Case No. 93 of 2024, subject to condition as laid down under Section 482 of the B.N.S.S.. (Prabhat Kumar Singh, J) shashank/- U T
