JUSTICE SUDHIR SINGH ORAL ORDER 09-08-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 302 and 201 of the Indian Penal Code. It is alleged by the informant Shiv Narain Pandey that his son was working in Silliguri PaniTanki. On 5.6.2011 in the morning he reached his home and told that he is going to petitioner's home and went there bicycle. From there he rang that he will return tomorrow. Next day on 6.6.2011 in the morning a dead body was found in village Naya Tola,Basantpur,Devigunj near a Pipal Tree. He went there and saw his dead son neck tied with plastic rope and it seems that he has been killed somewhere else and body was thrown here.
It is submitted on behalf of the petitioner that the
Patna High Court Cr.Misc. No.24532 of 2016 (4) dt.09-08-2016 2/2 petitioner is in custody since 31.06.2016.Charge sheet has been submitted in this case. The petitioner has got no criminal antecedent. There is no allegation of tampering of the witnesses against the petitioner. The petitioner is not named in the FIR. The petitioner happens to be the Mousa of the deceased. Except suspicion there is no other material to implicate the petitioner in the present case.
On behalf of the State, it is submitted that the petitioner is not named in the FIR.
Considering the aforesaid facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Amit Kumar Tiwari, learned Judicial Magistrate,1st Class, Muzaffarpur in connection with Karja P.S.Case No. 71 of 2011.
