The petitioner seeks bail in a case registered under Sections 461, 379, 411 of the Indian Penal Code. The prosecution case in short is that unknown thieves committed theft of Monitor, CPU and Hard disk of Dell from shop of the informant.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 01-07-2018. The petitioner has remained in custody for nine months. The offences are triable by the Magistrate. The petitioner has been made accused in the

Patna High Court CR. MISC. No.10609 of 2019(3) dt.12-04-2019 2/2 present case due to mistake of fact. The other co-accused with similar allegation have been granted bail by a coordinate bench of this court vide order dated 10-12-2018 passed in Cr. Misc. No. 70649 of 2018.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Purnea in connection with Jalalgarh P.S. Case No. 51 of 2018.
