2. Permission is accorded.

3. Accordingly, the instant petition is dismissed as withdrawn.

4. However, learned appellate court is reminded that when a Coordinate Bench of this Court vide order dated 05.09.2022 passed in Civil Misc. No.44 of 2020 requested it to dispose of the appeal on its merit as early as possible preferably within three months, it was expected that appeal would be disposed of within stipulated period. But, as has been submitted by the parties, the appeal is pending even after much time has elapsed since the date of passing of the aforesaid order of the Coordinate Bench.
