The petitioner seeks bail in a case under Sections 302 and 394 of the Indian Penal Code.
The petitioner is not named in the F.I.R. For the first time, one Bijendra Kumar in para 22 and Luv-Kush Kumar in para 23 disclosed the name of Laxman Pandey, who used to visit the shop of the deceased. The petitioner and Sachin Kumar were apprehended and the police took confessional statement of the petitioner. Except the confessional statement, the police did not collect any further evidence. It appears that Sachin Kumar, who was arrested with the petitioner, has already been enlarged on bail. Laxman Pandey and Uday Yadav have been granted anticipatory bail by the learned Sessions Judge vide order passed in ABP No.
Patna High Court Cr.Misc. No.10643 of 2015 (3) dt.02-04-2015 2/2 22204/14 and ABP No. 24872/14.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge IV, Patna in Masaurhi P.S. Case No. 275/14, corresponding to G.R. No. 695/14.
