The petitioner seeks bail in a case instituted for the offences under Sections 364(A) of the I.P.C. Later on, Sections 302, 201 and 120B of the I.P.C. was added.
The prosecution story, in brief, is that in course of morning walk the brother of the informant was kidnapped by 6-7 unknown criminal forcibly from the Railway platform, Pachrukhi with intention to kill or ransom.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 5.2.2016 and the charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. The
Patna High Court Cr.Misc. No.36806 of 2016 (3) dt.26-10-2016 2/2 petitioner is not named in the F.I.R. His name has come on the confessional statement of the co-accused. The other co-accused have been granted bail vide Cr.Misc.No.25824 of 2016, Cr.Misc.No.18792 of 2016 with Cr.Misc.No.20873 of 2016, Cr.Misc.No.9765 of 2016 with Cr.Misc.No.11312 of 2016 with Cr.Misc.No.12579 of 2016.
On behalf of the State and the learned counsel for the informant, it is submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of A.D.J. II, Siwan in connection with Sessions Trial No.335 of 2016 arising out of Pachrukhi P.S. case No.301 of 2015.
