JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-04-2015 Petitioner is languishing in custody since 28.11.2014 in a case registered for the offences punishable under Sections 290 of the I.P.C and Section 47(A) of the Excise Act.

From the manufacturing units of illicit liquor, 80 litres of mahua liquor, 27 plastic drums and other equipments for manufacturing the same have been recovered. It is submitted by learned counsel for the petitioner that fragmented mahua were destroyed. Moreover the recovery can not be treated from the possession of the petitioner and there is noting on record to suggest that manufacturing unit was run by this petitioner. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the
