The petitioners seek regular bail in connection with Hilsa Police Station Case No. 397 of 2020, registered for the offence punishable under Section 302/34 of the Indian Penal

Patna High Court CR. MISC. No.43877 of 2021(3) dt.25-04-2022 2/3 Code.

The prosecution case, as per the First Information Report, is that in the morning of 14.08.2020, the husband of the informant went to attend the call of nature, but did not return and on 16.08.2020, the dead body of the informant's husband was found lying in a field, with an electric wire, passing through the dead body.

Learned Counsel for the petitioners submits that the petitioners are named in the First Information Report on the basis of suspicion on the ground that there was a quarrel between the grandson of the informant and the petitioners sometime back. He further submits that the post mortem examination of the dead body of the deceased was conducted, but the doctor has not found any external injury on the dead body and the cause of death has also not been ascertained and the viscera has been sent for forensic examination. He further submits that the petitioners are is in custody since 31.01.2021 and 19.03.2021 respectively and charge sheet has been submitted against them and as such there is no likelihood that the petitioners will abscond and/or tamper with the evidence. Regards being had to the submission advanced on behalf of the parties and taking into consideration the materials

Patna High Court CR. MISC. No.43877 of 2021(3) dt.25-04-2022 3/3 on record and the fact that the petitioners have been made accused on the basis of suspicion only, the cause of death has not been ascertained by the doctor, they are is in custody since 31.01.2021 and 19.03.2021 respectively and charge sheet has been submitted against them, I am inclined to grant regular bail to the petitioners.

These applications are, accordingly, allowed. Let the petitioners, above named, be released on bail, upon furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned 1st Additional Chief Judicial Magistrate, Hilsa (Nalanda), in connection with Hilsa Police Station Case No. 397 of 2020.
