The present writ petition was filed with a prayer to direct the respondents to absorb the petitioners/instructors, who were working at different Non-formal Education Centre, situated in the district of Rohtas.
Learned counsel for the petitioners submits that after closure of the Non-formal Education Centre, the Supervisors and instructions were thrown on the road. Subsequently, the State Government took a policy decision to absorb all the supervisors. In the light of decision taken by the State, while absorbing the supervisors, a Bench of this Court vide order dated 21.04.2011 passed in C.W.J.C.No.8418 of 2010, in which there were 292 petitioners, allowed the writ petition and directed the Respondents to identify such instructors of the Programme, who were validly appointed ans subsequently stand thrown out on account of closure of the Programme and issue orders for their absorption positively within a period of four months.
Learned counsel for the petitioners by way of referring
Patna High Court CWJC No.13200 of 2008 (2) dt.04-09-2015 3/3 to an order passed in L.P.A. No.1489 of 2011 submits that against the order of the writ court i.e. order dated 21.04.2011 passed in C.W.J.C.o.8418 of 2010, the State preferred an appeal vide L.P.A. No.1489 of 2011. A division of this Court vide its order dated 11.08.2015 has dismissed the L.P.A. Meaning thereby the order of the Single Bench has already been approved.
In view of the order passed by the writ court and approved by the L.P.A. Court, learned counsel for the petitioners makes a prayer for disposal of the writ court on the same terms.
Accordingly, the writ petition stands disposed of in terms of order passed in C.W.J.C.No.8418 of 2010 and approved by the Division Bench in L.P.A. No.1489 of 2011. (Rakesh Kumar, J) NKS/- U
