This is an application for bail in connection with Jogbani P.S.Case No. 62 of 2013 registered for the offences punishable under Section 376 of the Indian Penal Code. Allegation against the petitioner is of committing rape upon the informant on the assurance of marriage and the case is of 2013.

It has been submitted on behalf of the petitioner that this case is false and concocted and the victim in her restatement has made other version and has not made allegation against him and due to pressure she has filed this case. It has further been submitted petitioner is in custody since 7.2.2017. Heard learned APP also.

Patna High Court Cr.Misc. No.30504 of 2017 (3) dt.25-07-2017 2/2 Having heard both sides and in view of nature of allegation and the case is of the year 2013 and he surrendered on 7.2.2017, almost after four years, I am not inclined to grant bail to the petitioner.

However, learned trial court is directed to expedite the trial and try to conclude it as soon as possible. With the above observation, this application is dismissed.
