The petitioner is in custody since 12.09.2016 in connection with Mahua P.S. Case No.306/2014 registered for the offences punishable under sections 366, 366A, 120B/34 of the Indian Penal Code.
The accusation is of kidnapping the minor daughter of the informant with intention to perform marriage with her.
Learned counsel for the petitioner submits that the victim was not kidnapped rather she of her own went in the company of the petitioner and has performed marriage as she was in love with him from before and she is pregnant. He further
Patna High Court Cr.Misc. No.49838 of 2016 (3) dt.28-01-2017 2/2 submits that the victim is residing with her at his house as wife. Moreover, the victim is not a minor she is aged about 19 years. The victim has sworn an affidavit to that effect which is annexed as annexure-2 to the application.
Considering the aforesaid fact, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Vaishali at Hajipur, in connection with Mahua P.S.
