Petitioner is languishing in custody since 01.09.2016 in connection with Khajauli P.S. Case No. 165 of 2016 for offences punishable under Sections 272 and 273 of the Indian Penal Code and 47(a) of the Bihar Excise (Amendment) Act, 2016. It is alleged that 176 bottles of Nepali domestic liquors and 51 bottles of Nepali foreign liquor were recovered from the house of the petitioner.

Submission on behalf of the petitioner is that the petitioner is in custody from 01.09.2016 and he has got no criminal antecedent.

Considering the nature of allegation against the

No.52734 of 2016 (2) dt.07-12-2016 2/2 petitioner, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Madhubani, in connection with Khajauli P.S. Case No. 165 of 2016.
