This application for anticipatory bail arises out of Rafiganj P.S. Case No. 196 of 2018 for the offence under Sections 147, 148, 149, 341, 323, 324, 353, 427, 224, 225, 307, 338, 379, 504, 333, 332 and 393 of the Indian Penal Code. There are 26 persons named in the First Information Report, who along with 50 others are said to have participated in commission of the offence. The informant is Sub Inspector of Police and it is alleged that all the accused persons forcibly got an accused, who was arrested by the police in another case, free from the clutches of the police. It has been submitted that the allegation is general and omnibus and other similarly circumstanced co-accused persons have been granted anticipatory bail by order dated 08.01.2019 passed in Cr. Misc.
Patna High Court Cr.Misc. No.3670 of 2019(2) dt.25-01-2019 2/2 No. 77704 of 2018.
Considering the aforesaid submission, this application is allowed.
Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Aurangabad in Rafiganj P.S. Case No. 196 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
