The petitioner has moved the Court for the following reliefs:- "That this is an application for issuance of an appropriate writ/writs, order/orders, direction/directions in the nature of mandamus/certiorari for quashing of the order contained in letter no. 5207 dated 20.09.2004 whereby and where under the Joint Commissioner, Accounts Administrations Directorate of Provident Fund (respondent no. 2) has held that the petitioner is not entitle to payment of G.P.F. interest and further held that calculation Chart shows an excess payment of Rs. 8769/- against the petitioner and

Patna High Court CWJC No.14162 of 2008 dt.22-02-2018 2/2 further prayer for commanding and directing to the respondent authorities to issue an authority slip for payment of balance of legally accrued amount on G.P.F. which is Rs. 33917/- excluding further interest till payment is made to the petitioner along with up to date accrued interest and for the other necessary reliefs for which the petitioner is entitle to in accordance with law."

Counter affidavit has been filed on behalf of the respondents No. 2 and 3 after service of copy to learned counsel for the petitioner on 20.08.2011. Counter affidavit has also been filed on behalf of the respondent no. 4.

The ground taken in the counter affidavit on behalf of the respondents No. 2 and 3 indicates that the action of the respondents is as per the provisions relating to payment of G.P.F. and interest thereon.

There being no rejoinder to the same and nobody appearing on behalf of the petitioner to press the writ petition, the same stands dismissed, both on merits and on account of nonprosecution. (Ahsanuddin Amanullah, J.) Ajay Gupta/- AFR/NAFR U
