JUSTICE SHIVAJI PANDEY ORAL ORDER 01-02-2019 In this case, the petitioner is seeking anticipatory bail in connection with Dumariyaghat P.S. Case No.120 of 2017, registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The Police has intercepted a vehicle, from where huge quantity of illegal liquor has been recovered and the person, who has been apprehended, has informed that the present petitioner is the owner of the liquor. Learned counsel for the petitioner has placed reliance on the order dated 01.05.2018 passed in Criminal Miscellaneous No.26531 of 2018, in that case one of the grounds for release on bail is that the vehicle, in question, is not standing in the name of the petitioner of that case. Patna High Court Cr.Misc. No.2903 of 2019(3) dt.01-02-2019 2/2 vide order dated 24.01.2019 has given direction to the petitioner to file an affidavit, making specific statement as to whether the petitioner is owner of the vehicle, in question, or not, but till date no such affidavit has been filed by the petitioner. In such view of the matter, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected.
