JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 01-02-2024 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 341, 323, 324, 379, 380, 376, 511, 307, 427/34 of the Indian Penal Code.

It is alleged against the petitioner and coaccused Raja Kumar that they entered into the house of the informant and made an attempt to commit rape with the daughter-in-law of the informant and when she made protest and raised alarm, the other family members came. It is alleged that the accused persons

Patna High Court CR. MISC. No.3878 of 2024(2) dt.01-02-2024 2/3 assaulted the informant and other family members and snatched the gold/silver ornaments and cash from the house of the informant.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. For the alleged occurrence of 29.06.2022, the F.I.R was registered on 10.08.2022 without explaining the delay. There is counter version of the occurrence also and petitioner's side also sustained injuries. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief
