2. The petitioner seeks bail in connection with Katihar Muffasil P.S. Case No. 266/2025 registered for the offences punishable under Section 309(6) of B.N.S.

3. As per the prosecution case, a TOTO was looted by unknown criminals who threatened the informant with a knife. The TOTO was later recovered from the petitioner, who was caught by the villagers.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in the case. It is next submitted that no TOTO has been recovered from his possession but from a field. Learned counsel further submits that he has no criminal antecedent and he is in custody since 03.11.2025. The

Patna High Court CR. MISC. No.1134 of 2026(4) dt.16-04-2026 2/2 petitioner undertakes to co-operate in the case/ trial.

5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

6. Considering the fact that the petitioner was caught by the villagers with the looted vehicle, this Court is not inclined to grant bail to the petitioner.
