JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 25-01-2016 By way of the present application preferred under Articles 226 and 227 of the Constitution of India, the petitioners seek following relief:
"1. That this is an application for issuance of appropriate writ or order or direction for grant of releifs as follows:
(i) For issuance of writ of mandamus commanding the respondent authorities particularly Respondent no.2 to measure and demarcate the land of khata no.333, plot no.922 situated at Mouza Bhaisasur Thana 122, Anchal Biharsharif, Distt-
Patna High Court Cr. WJC No.299 of 2015 (2) dt.25-01-2016 2/2 Nalanda in compliance of order dated 24.4.2014 passed by the Sub Divisional Magistrate, Biharsharif in connection with Case No.161(M.P.) of 2014 under Section 144 Cr.P.C. to ascertain the physical possession of the land in question and to decide the matter.
(ii) That for issuance of writ of mandamus commanding the respondent authority directing them to take appropriate legal action against the erring party."
After some argument, learned counsel for the petitioners seeks leave to withdraw this application in order to seek other statutory remedy/remedies available in law to the petitioners. Leave is granted. The application is dismissed as withdrawn.
