JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-11-2019 The present writ petition has been filed for making payment of the pensionary benefits, upon voluntary retirement as an Advocate.
The learned counsel appearing for the respondent nos. 3 & 4 has submitted that as per the Schedule fixed in the scheme notified vide gazette notification dated 22.12.2006, which is applicable in the case of the petitioner, he is entitled to get a sum of Rs. 43,500/- upon completion of 29 years of practice and the same has been paid as per the calculation chart annexed as Annexure-A to the counter affidavit filed on behalf of the respondent nos. 3 & 4. The aforesaid position as existing on fact and law is not disputed by the learned counsel for the petitioner. Hence, the present writ petition stands dismissed, however, with liberty to the petitioner to approach the respondent nos. 3 & 4 by filing a mercy petition. It is, however, clarified that no further writ petition would lie before this Court for the cause of action involved in the present writ petition.
