JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2020 This is an application for grant of anticipatory bail in connection with Bihra P. S. Case No. 169 of 2019 disclosing offences under Sections 341, 323, 324, 307, 379, 504, 506, 34 of the Indian Penal Code.

As per prosecution case on the order of petitioner no.1 and instigation of petitioner no.3, all the petitioners have assaulted the informant and other persons, causing injury. Submission of the learned counsel for the petitioners is that there is a case and counter case between the parties. Though one injury of Santosh Kumar and opinion on one injury of Kamleshwari Yadav was kept reserved, but that injury on Kamleshwari Yadav was not on vital part of the body.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned C.J.M., Saharsa, in connection with Bihra P. S. Case No. 169 of 2019.
