JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-04-2022 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 25(1-B)a, 26 and 35 of the Arms Act.

As per the prosecution case, one country made pistol and one live cartridge were recovered from the possession of the petitioner.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner. He is in custody since 30.6.2021. Investigation is complete.

Considering the aforesaid facts and circumstances of the case and the period of custody of the petitioner, prayer for

Patna High Court CR. MISC. No.2245 of 2022(3) dt.08-04-2022 2/2 bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate III, Dalsing Sarai, District Samastipur in Vidyapatinagar Police Station Case No. 77 of 2021.
