====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 09-05-2023 Heard learned counsels for the petitioner and the State.

Petitioner apprehends arrest in a case registered for the offences punishable under Sections 420, 406 and 409 of the Indian Penal Code.

The prosecution case, in a nutshell, is that this petitioner, along with other co-accused persons, defalcated the Government money in the name of several schemes and for development purposes.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He next submits that petitioner was simply a Panchayat Secretary of the panchayat in question. Entire work

Patna High Court CR. MISC. No.2929 of 2023(2) dt.09-05-2023 2/2 was executed under the supervision of the co-accused Mukhiya. Moreover, entire scheme of the Government for which the money was allocated and withdrawn has been found completed and correct by the Sub-Divisional Officer after thorough physical verification. Petitioner has got clean antecedent. Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Jhanjharpur, District Madhubani in connection with Bhairavshthan P. S. Case No. 55 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
