JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-03-2015 Petitioner is languishing in custody since 15.05.2014 in a case registered for the offences punishable under Sections 25(1-B)a, 26(1-A), 26(1), 26(2), 26(3) and 35 of the Arms Act.
On information the police raided the place when equipments of arms manufacturing unit, semi furnished arms and ammunitions were recovered. The petitioner and one Dilip Kishku were apprehended from the seizure. It is submitted by learned counsel for the petitioner that seizure list can not be treated from the possession of the petitioner and the similarly situated coaccused Dilip Kishku has been granted bail vide Cr. Misc. No. 44327 of 2014.
Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail
Patna High Court Cr.Misc. No.9131 of 2015 (2) dt.04-03-2015 2/2 bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Munger in connection with Kharagpur(Gangta O.P.) P.S. Case No. 119 of 2014. Since the petitioner is accused in one other case of similar nature, let learned Court below cancel the bail bonds of the petitioner, if the petitioner gets substantially involved in similar nature of offence or defaults for three consecutive occasions during trial.
